Tyddyn Bach Dog Park, Conwy, North Wales

Terms and condition are set out below - please ensure you read the terms and conditions as booking constitutes acceptance.

Full Terms and Conditions

1. THE OFFERING OF SERVICES
1.1.a. The Customer wishes to hire a facility space from Tyddyn Bach Dog Park for a set period, and Tyddyn Bach Dog Park agrees to permit the hire of the facility space as set out in accordance with the terms and conditions within this Agreement.
1.1.b. For the avoidance of doubt, the facility spaces available for hire is a Secure Dog Field offered by Tyddyn Bach Dog Park and are hereafter referred to as “the Facilities”.
1.1.c. Facilities are offered for minimum hire periods of 30 (thirty minutes).
1.1.d. Tyddyn Bach Dog Park shall be responsible for ensuring that it complies with all statutes, regulations, byelaws, standards, codes of conduct and any other rules relevant to the provision of the Facilities.

 

2. BOOKING, CANCELLATIONS AND PAYMENT
2.1.a. Bookings shall be made via www.tyddynbachdogpark.co.uk
2.1.b Bookings shall not be considered as ‘confirmed’ until Tyddyn Bach Dog Park provides the Customer with a confirmation in writing noting the facility and time booked.
2.1.c. Payment is required in full on booking through the website. Approved payment methods are listed on the website.
2.1.d. Customers may cancel or reschedule their booking up to 72, (seventy-two hours) prior to the booking date and start time, after which the booking is due in full.
2.1.e. Customers wishing to cancel due to their dog being unwell may reschedule a booked session within the non-cancellation period by contacting Tyddyn Bach Dog Park directly by telephone. Only 1 (one) reschedule of the booked session is permitted. Evidence of a vet visit may be requested from the Customer by Tyddyn Bach Dog Park on a case-by-case basis.
2.1.f. Bookings are personal to the Customer and may not transferred or sublet to any other person without prior written consent from Tyddyn Bach Dog Park.

2.1.g. BUSINESS CANCELLATIONS: Tyddyn Bach Dog Park shall use all reasonable endeavours not to cancel booked services, however if cancellation is necessary at short notice (i.e. due to damage or safety risks identified), all monies paid for the Services shall be repaid to the Customer. 

2.1.h. Bookings for services to be carried out at the weekend or bank holidays may be charged at a different rate to weekday services and will be documented on the website.
2.1.g. The Customer agrees to pay for any damage to property arising from the behaviour of their dog on presentation of a valid receipt for replacement goods, or a quote for
damage repair. If the Customer fails to make payment on a due date, then Tyddyn Bach Dog Park shall, without prejudice to any other rights or remedies of Tyddyn Bach Dog Park, have the right to charge the Customer interest on a weekly basis at the rate of £10 per week. Should any additional payment due under this Agreement remain unpaid for 28 (twenty eight) days after it falls due, Tyddyn Bach Dog Park will be relieved of their contractual obligations under this Agreement to provide the Services until such time as payment is made.

3. PRICING AND RATE REVIEWS
3.1.a. Hire rates are reviewed annually. Customers shall be given a minimum of 1 months’ notice of planned rate changes.
3.1.b. Any bookings already made and paid for shall be honoured at the price at the time booked, regardless of subsequent changes to hire rates.

4. STANDARDS AND INSURANCE
4.1.a. Tyddyn Bach Dog Park agree to provide a professional and reliable hire service to their customers. All Facilities will be given the care and attention needed to make customer experiences both fun and safe.
4.1.b. Customers, however, must accept that accidents or illness may occur in such a manner that can neither be foreseen nor prevented by Tyddyn Bach Dog Park. Tyddyn Bach Dog Park shall be held harmless in the following circumstances, unless Tyddyn Bach Dog Park can be shown to be negligent.
4.1.c. Tyddyn Bach Dog Park has business insurance for the premises but recommends that customers have insurance for their dogs to cover any mandatory excess.

 

5. CUSTOMER’S OBLIGATIONS
5.1.a. When booking the Facilities, “The Customer” may be an individual dog owner, or a company hiring the Facilities for the use of their customers (only with approval). Customers booking for themselves and another dog owner to share the facility area are directed to the Multi-Party Booking section of these Terms and Conditions.
5.1.b. The Customer shall use all reasonable endeavours to provide information to Tyddyn Bach Dog Park necessary for Tyddyn Bach Dog Park to provide the Facilities and agrees that the information provided to Tyddyn Bach Dog Park is true to the best of their information, knowledge and belief.
5.1.c. The Customer agrees to use the Facilities for exercising dogs, always keeping them under close personal supervision.
5.1.d. It is the responsibility of the Customer to ensure that the dogs brought to use a facility area are in good health and comfortable in each other’s company.
5.1.e. Customers agree to keep the Facilities clean and tidy and shall ensure that all litter generated by the Customer shall be removed at the end of each booked period. This includes dog excrement. A removal charge shall be imposed if litter or excrement is not removed at the end the booked session.
5.1f. For the health and safety of all, if damage to boundary fencing is noticed, Customers agree to alert Tyddyn Bach Dog Park immediately so that it may be addressed.
5.1.g. Customers agree to manage noise whilst using the Facilities so that it does not cause a nuisance to others using other Facilities, or residents of the surrounding areas.

 

6. MULTI-PARTY BOOKINGS
6.1a. Customers may share their booked session with 1 (one) additional dog owner. Whilst additional owners must also adhere to these Terms and Conditions they must correspond with Tyddyn Bach Dog Park via the party that has paid for hire of the facility area via the website, otherwise known as “the Customer”.
6.1.b. For the avoidance of doubt, these Terms and Conditions are in place between Tyddyn Bach Dog Park and the party that has paid for hire of the facility area via the website, otherwise known as “the Customer”. Any formal correspondence with Tyddyn Bach Dog Park regarding the booking must be undertaken by the Customer on behalf of any sharing parties.
6.1.c. It is the responsibility of the Customer to ensure that dogs from different families that are sharing the Facilities are socialised together in advance. Tyddyn Bach Dog Park shall not be responsible for any injuries to dogs resulting from their behaviour within a group.

7. VACCINATIONS AND PREVENTATIVE HEALTHCARE
7.1.a. Dogs must be vaccinated in accordance with veterinary recommendation, including the vaccination for Leptospirosis. 
7.1.b. Kennel Cough vaccination is preferred but is not mandatory.
7.1.c. Customers must provide Tyddyn Bach Dog Park with evidence of the vaccination schedule by way of Vaccination Card or a letter or email from their Veterinary Practice on request. Titre testing results, as an alternative to DHP vaccination, are also acceptable.
7.1.d. Dogs must be treated to prevent worms and fleas. Customers accept that they will be responsible for the expense of removing worms and fleas from the facility area if evidence is found to be present during the post-hire inspection.

8. USE OF THE FACILITIES
8.1.a. Any lock codes or passwords given for the purposes of accessing Facilities may not be shared with others without prior written consent from Tyddyn Bach Dog Park. Any lock codes or passwords used will be changed frequently as a security precaution.
8.1.b. Vehicles may not be parked in any area that is not defined as a parking space for the Facility, unless awaiting for another customer to leave the Facility. 
8.1.c. Customers may not remove or obscure any Tyddyn Bach Dog Park notices displayed at the Facility.
8.1.d. The Customer must take good care of the Facility at all times and be responsible for any damage caused to the Facility (or equipment within it) whether forming part of the booking or not.
8.1.e. Dogs are not permitted to be tethered to structures, fencing, posts or gates on site at any time.
8.1.f. The Facilities are available in all weather. Cancellations due to weather are governed by the standard Cancellation Policy.

9. CUSTOMER COMPLAINTS
9.1.a Customer complaints must be received in writing within 5 (five) calendar days of the end of the service which has triggered the complaint. Tyddyn Bach Dog Park shall respond to the Customer within 5 (five) calendar days of receipt of the complaint. Tyddyn Bach Dog Park shall use all reasonably practical measures in order to resolve the issue, and discussions about the complaint are made in good faith.

10. FORCE MAJEURE 
10.1.a. Neither party shall be liable in damages or have the right to terminate this Agreement for any delay or default in performing its obligations under this Agreement caused by conditions beyond its control including but not limited to acts of God, war, strikes, fires, floods, governmental restrictions or power failures.
10.1.b. The Party (the “Affected Party”) prevented from carrying out its obligations shall give notice to the other Party of an Event of Force Majeure upon it being foreseen by, or becoming known to, the Affected Party.

11. PRIVACY POLICY
11.1.a. Personal information shared with Tyddyn Bach Dog Park for the purpose of using Services will not be sold or shared with third parties, in accordance with GDPR 2018 (or subsequent revision). Information is held on paper and electronically for periods required by HMRC.
11.1.b. Customers are advised that Tyddyn Bach Dog Park may take and use photographs of pets for marketing purposes; however, no specifics pertaining to the name of the dog, or the owner will be divulged publicly unless with approval. Customers who do not wish for Tyddyn Bach Dog Park to use photos of their dog for marketing purposes must tell the company in writing via email.

12. GOVERNING LAW, ENTIRETY AND JURISDICTION
12.1.a. This Agreement, along with the booking constitute the sole and entire agreement between the Parties, and supersedes all prior agreements, representations and understandings of the Parties written or verbal. Any alteration of this Agreement must be in writing and signed by both Parties.
12.1.b. This Agreement, its formation and any contractual disputes or claims shall be governed by and in accordance with English/Welsh Law and shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12.1.c. Any Forbearance, tolerance or delay in either party enforcing its contractual or legal rights shall not prejudice, restrict or prevent the right of the injured party to enforce its rights at a later date or later breach.
